The website terms do not supersede any written commission agreement.
Crystal Dream Shift maintains professional indemnity insurance in accordance with industry standards. However, this insurance does not constitute a warranty of the outcome of any project, nor does it limit your rights to pursue legal remedies for professional negligence, where applicable.
Before commencing formal legal proceedings related to any dispute, we encourage both parties to attempt resolution through good-faith discussion. If a dispute cannot be resolved informally and either party wishes to pursue legal action, the dispute shall be subject to the exclusive jurisdiction of the courts of Tokyo, Japan, as stated in Section 7. The laws of Japan shall govern all proceedings.
If any provision of these Terms of Service is found by a court to be invalid, unenforceable, or unlawful, that provision shall be severed and the remaining provisions shall continue in full force and effect.
These Terms of Service, together with any separate written agreement you have with Crystal Dream Shift regarding architectural or design services and our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Crystal Dream Shift regarding your use of our website and engagement of our services. No other terms, understandings, or agreements, whether written or oral, shall modify these terms.
The failure of Crystal Dream Shift to enforce any provision of these Terms of Service shall not constitute a waiver of that provision or of any other provision. Any waiver of a provision must be stated in a separate written document signed by an authorised representative of Crystal Dream Shift.
